What are the warning signs of nursing-home neglect?
Bedsores and pressure ulcers, unexplained falls or fractures, sudden weight loss, dehydration, poor personal hygiene, and unexplained changes in behavior or mood. Financial red flags include missing property, unusual withdrawals, and sudden changes to estate documents.
How long do we have to file a claim?
Elder-abuse and personal-injury claims in California generally must be filed within two years - but shorter deadlines can apply to claims against public entities (six months to file a government claim) and to some medical-negligence claims. Don't wait.
What damages are available?
Medical expenses, pain and suffering, and - under Welfare & Institutions Code § 15657 - attorney's fees and enhanced pre-death pain-and-suffering damages where reckless neglect, oppression, fraud, or malice is proven by clear and convincing evidence.
